The term "Friends" refers to a member of the site who has been nominated by the artist in their Friends list.
The terms "Member" and "you", refer to registered users and general users of the website.
The term "Artist" refers to a member of the site who uploads images.
The term "Comments" refers to a comment added by a member in relation to a stored image.

(3) Intellectual property rights
Unless otherwise stated, we or our licensors own the intellectual property rights in the website and material on the website. Subject to the licence below, all our intellectual property rights are reserved. Images uploaded to the site by an Artist remain the property of the Artist.

(4) Licence to use website
You may view, download for caching purposes only, and print from the website, provided that:

(a) you must not republish material from this website (including republication on another website), or reproduce or store material from this website in any public or private electronic retrieval system;

(b) you must not reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit our website or material on our website for any purpose, without our express written consent;

(5) Limitations of liability
The information on this website is provided free-of-charge, as any fee is purely for the purpose of storing images and therefore you acknowledge that it would be unreasonable to hold us liable in respect of this website and the information on this website.

Whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness or accuracy. We not commit to ensuring that the website remains available at all times or that the material on this website is always up-to-date.

To the maximum extent permitted by applicable law we exclude all representations, warranties and conditions (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill).

Members will be held directly accountable for their own comments made on the website. In particular any distress or damage as a result of their defamatory comments, threats, untrue statements or other illegal and fraudulent claims made by them.

You must not use our website for any purposes related to marketing without our express written consent.

You must not use our website to copy, publish or send mass mailings or spam.

You must not use our website to copy, publish or send material which is illegal or unlawful, or material which could give rise to legal action under English and other applicable law. You must not use our website to insult or defame Childrensartclub.co.uk in anyway. Members must not post communication between them and employees of Childrensartclub without express prior consent.

All comments must be made in English so that they can be read by other members and moderators.

You must not use the website to: access and/or use confidential information; attempt to discover and/or use the password and account details of another member; or attempt to impersonate any other person.

Our decision is final and we reserve the right to edit or remove any material posted upon our website which we consider unfit for the website. While the material entered on the website by members will be monitored by us, we are under no obligations to do so and can not guarantee the speed in which we will act upon unsuitable material.

We may take such action as we deem appropriate to deal with the posting of unsuitable material, including suspending or cancelling your account, restricting your access to our website, or commencing legal proceedings against you. Childrensartclub also reserves the right to disclose a member's personal information where required to do so by law and where Childrensartclub deems it appropriate in response to complaints of a substantial nature.

In respect of all material that you post on our website, you grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate and distribute such material in any media, together with the right to sub-licence such rights.

(8) Membership

All new artists will be given a free account to upload 2 pieces of art. To upgrade accounts to add more pictures, create stationery and to enter competitions artists will be required to pay a membership fee as listed below.
Accounts for adding comments are free.

(9) Membership fees

Individual Membership

£4.99 per annum for 10 picture credits

£9.99 per annum for 25 picture credits

£19.99 per annum for 60 picture credits

Family Membership

Families with 2 Artists

Silver Membership - £7.49 per annum. 2 individual accounts each of 10 picture credits.

Gold Membership - £14.99 per annum. 2 individual accounts each of 10 picture credits.

Platinum Membership - £29.99 per annum. 2 individual accounts each of 10 picture credits.

Families with 3 Artists

Silver Membership - £9.99 per annum. 3 individual accounts each of 25 picture credits.

Gold Membership - £19.99 per annum. 3 individual accounts each of 25 picture credits.

Platinum Membership - £39.99 per annum. 3 individual accounts each of 25 picture credits.

Families with 4 Artists

Silver Membership - £12.49 per annum. 4 individual accounts each of 60 picture credits.

Gold Membership - £24.99 per annum. 4 individual accounts each of 60 picture credits.

Platinum Membership - £49.99 per annum. 4 individual accounts each of 60 picture credits.

(10) Membership Cancellation/Refunds

Any member wishing to cancel their mebership or request a refund within 30 days of paying to join Childrensartclub will receive a full refund. No refund is offered after 30 days.

(11) Variation

We may revise these terms and conditions from time-to-time. Please check this page regularly to ensure you are familiar with the current version.

(12) Entire agreement
These terms of use, together with our privacy policy constitute the entire agreement between you and us in relation to your use of our website, and supersede all previous agreements in respect of your use of this website.

(13) Law and jurisdiction
This notice will be governed by and construed in accordance with English law, and any disputes relating to this notice shall be subject to the exclusive jurisdiction of the courts of England.
